Things are not going as we had hoped or expected. At this time, there are no cases being tried while certain issues are in the appellate court. As you know, I have retired and no longer have an office in Miami. Most of you executed authorizations to transfer your cases to one of my co-counsel. Because of the appellate process and poor trial results, my co-counsel have been reluctant to take your cases. There have been seven flight attendant cases which have had jury trials. Six of these were won by the tobacco companies. In one of the six, the judge granted the flight attendant a new trial. Tobacco has appealed her ruling. In the case where my colleagues were successful, the tobacco companies have taken an appeal. Neither of the appeals have dates for oral argument, but briefs have been filed. The outcome of these appeals will determine whether any of the flight attendant second-hand smoking cases are viable. For follow up, you may call me at 800-487-9060
